legal action? i want some help.

hey guys, ive had a problem with my oil pan gasket leaking recently... i had it replaced... long story short, it started leaking again, and the company replaced it free (as they should have it was within the warranty period)

well it started leaking YET AGAIN. and i took it to a different shop to have them look at, and replace it.

they showed me that the company did not even have 1/2 of the gasket on the back half of the pan, hence the leak. now, can i go back against the original company who did the work? it is warrantied for 5 years or 50K miles. i had this service done in january (the 10th to be exact).

i dont want to start problems, but i do want to have some money which i wasted be paid back to me for the time at work lost, the expense of the oil i have been topping off for so long, and the fact that i had to pay another company to fix the error. and as of today, my car has died. its knocking really badly and i cannot go over 40 mph. i was topping the oil off in this car every day for so long... i dont know what happened, but it is dead. not sure exactly what is wrong yet, but i believe it spun a rod bearing, and possibly some other good stuff... now i dont know how this works exactly. but they did not perform the service of replacing my oil pan gasket... it was only half there (and made out of RTV, not a gasket at all). along with that, they did not clean out my throttle body, or if they did, somehow there is a really thick layer or black carbon buildup in less then 5K miles. what can i do about this?

Go back and talk to the head manager, bring a written statement from the shop who fixed it stating what you've stated here and they may refund you. As far as replacing the money you spent on oil I think youre sol there.

the reason i cant do that is im in South Carolina, and the shop is in Maryland. im going to call their corporate today because they never answer the phone anymore at the location. im not to worried about the oil. but i figured i would throw it in there.

that must of been a pretty large leak if you had to top the oil off every day.
Would the low oil light come on while you are driving?
I don't understand why you would still drive the car if you noticed such a large leak.
Good luck with this, you might get your money back for the gasket job but other then thats I don't think your going to get anything else back.

If your engine blew because they didn't do the gasket correctly, that's your fault, not theirs.

Nobody asked you to drive it so long and keep topping it up. Bring it right back and have the work performed again for free, or do as you did and take it to another shop for a 2nd opnion. But DO NOT drive it.

That engine is something that you'll have to pay for, nobody put a gun to your head and told you to drive it in that condition.

the low oil light would only come on if i didnt top it off...
i drove it because its my only transportation and i was told that if it was possible to bring it back to MD that they would look at it. so they suggested that i drive it back, but check the oil every X miles. so i did just that. i know it was an old motor anyway, but im really not looking for them to replace the whole thing.
just the stuff they fudged up... i.e. the gasket which was not a gasket, and the throttle body not cleaning.

i wasnt thinking clearly when i assumed they would pay for a majority of the work, but if i get the money for the gasket and the cleaning i will be "happy"
