Got pulled over tonight
Saturday, November 05, 2005 11:46 PM
well i'm heading home from out eating with my friends and after this turn i gave it some gas and shifted like 4.5k out of 1st gear and gave it a little more gas in 2nd so i'm prolly doing like 45mph (50 tops) if i'm going by the sound of my car and what gear i was in. then i let off the gas completely and y the time i realize it some cop pulled right up next to me. i took a double take too see if i really seen him by this time i had slowed down to like 35mph bc i was just coasting after i gassed it. and he yells at me ur going to fast and i asked ihm nicely , what is the speed limit 35? and then he goes ok a$$hole pull over by this time after him yelling to me and stuff (i was stll coasting) i was doing 25mph bc i put it into 3rd gear and it was real sluggish when i gave it gas to pull over. so in the end i got 115$ ticket for careless driving. i asked him how fats i was going he bascially told me dont worry about it, it doesnt matter. yea nice end of a good night lol. yes i am fighting it bc he pulled me over when i was doing 25-30mph and didnt tell me how fast i was going when he pulled me over. in the end it was 12:45 his shift was over in 15min i was 2 mins away from station he needed to pull in a ticket to end the night.

no recorded speed = no case.... you win. Take it to court, chances are he wont show to a case he can't win.

no dude, normally that would be true
but he sed he was given a ticket for careless driving, not speeding
you dont have to be speeding to be careless driving
i got a ticket for that once, i "burned out" at a stop sign when in actuallity i chirped my tires, anyway i was only doin 25 in a 35 when the cop got me, i took it to court and lost
i'd still fight it tho, you may be lucky, but dont count on winnin it

your from pa, even if it was speeding he still can get you for it w/o a dectector. i got a speeding ticket when i lived in pa. i looked at it and there is a whole list under speeding and i believe one of the boxes is judgement so they dont need to use a gun to dected your speed. even so, i would still fight it. everytime ive gone to go, its either been dropped or reduced

bagged is right, its easy to get it dropped/reduced, and around here where i live (in PA) half the time cops dont show up unless its big fines.

and i think its bull@!#$ that he gave you a careless driving considering the fact that he pulled up along side you and started yelling at you (plus him calling you an @!#$ should help your case if thats true)

only problem you might have is your word vs. a troopers word, and thats the only part i would be worried about.

good luck though.

take it to court, chances are u can win, heres what you can say:
it was 15 min b4 his shift was over, so he's only rushing on things-he might had made a misjudgement on your speed and/or 'careless driving'
did he say what sort of careless driving u were doing to alert you of the danger? if not, then you can argue that
the possibilty of him not remembering the event entirely can be on your side.
i got a ticket for 150 for failing to stop at a stop sign, only yielded. i argued him in court because i was making a right turn and the 'T' intersection was a blind spot from where i was turning onto(it was in the back roads and the reason for the blind spot were because of the height of corn). the moment i made the turn and was straight again i saw the cop and he made a u-turn and flipped his lights and pulled me over. i asked him what i did wrong, but he just gave me the ticket and that was it. later in the week i called his station and filed a complaint to his superior, and his superior was pissed off that the officer did not explain the reason fo the pull-over(its suppose to be procedure to ask and tell citizens)..long stry short i told the judge the cop made a misjudgement and 'assume' i yielded because he couldnt really see my stop at all because of the corn and i won.
*that was long whew

took the words outta my mouth.
can't really hurt to fight it, unless you lose and you pay court fees over the $115.
any sort of erratic driving (taking off to fast, burning tires, screeching tires around a turn, braking erratically) can be careless driving.

slowly but surely...

i got pulled over the other night for failing to use a turn signal... the cop was trying to get me for accelerating on an on-ramp (took 2nd gear to about 4.5k rpms before going to 3rd and he heard my exhaust) and instead pulled me over for the turn signal when i passed a car. i didn't get ticketed though.

i'd fight it. the fact that he didn't tell you exactly why he pulled you over i would think should be enough to have it turned in your favor. how are you supposed to refrain from driving "carlessely" when you don't know what you were doing to be given the ticket.

Deff take it to court but he nailed you for careless driveing cause you didn't know what the speed limit was. You may beat it you may not but at least try.

Semper Fi SAINT. May you rest in peace.
