INSURANCED LAPSE+ CAR ACCIDENT?

Well, on Wed of this week my '04 cavy was T-boned..cops came and I couldn't find my insurance card, but whatever , they issued me a ticket for no proof of insurance,...I called my insurance company and made my claim, not knowing that my insurance had lapsed..we payed what I owed...my question is, will insurance still cover my damages even though it was lapsed, or am I just chop liver...the payment was due on April 19, with 22 day grace period..and we re-enstated it on May 31st, the day the accident happened, ..this sucks...isn't there a law that says that they have to send us a confrimation, stating that our insurance has been cancelled.?....which we never recieved, thanks in advance

Me thinks your screwed.

But you got nailed right? Did the cops find you or the other guy at fault? If they faulted you then your screwed big time ! Not only is your car gone but the other car......who's pocket do you think its gonna come out of to fix ? And God help you if you have no insurance and the people are hurt cuase they will take everything you own in court.

Now if its the other guys fault then his company has to fix your car. But if he doesn't have any either then your back to being screwed again as you'll have to fix your car out of your pocket as you ahve no insurance to fix it for you.

I could be wrong and I hope I am but this is bad, real bad.

Well, we are both State Farm, so that's is good..my agent turned in my claim, so they must be figuring it out....I am still waiting to hear from the adjusters, is this normal, does it take a while?...and yes I supposedly was at fault, but I believe she crossed the center line, around traffic to make the left arrow...it's kind of hard to explain, unless you know the road...but I think I have some sort of case...the @!#$in' cop didn't even get out of her car...very caring right...I will post pics soon...

It is the consumers responsibility to know when the payment is due, and when the policy expires.
Most companies will send a courtesy reminder before cancellation, but it is just that....a courtesy.
They are indeed required to send a cancellation notice, but that would happen several days (or even a week or more) after the grace period, which you stated was up on 5/31, so that notice is probably in the mail now or soon will be. Or may not be now that you've paid up.

As to whether or not you will still be covered, it will depend heavily on your relationship with the insurance company and how nice they are feeling. With an actual lapse in coverage, you are technically out of luck. If you have been doing business with them for several years or more with no claims, and they are one of the major companies (Allstate, State Farm, etc.) then they MAY give you a break, but they are not required to.

yeah, we have been with them for atleast 10 years, State Farm....May 10th would have been the end of the grace period...I was re-estated on May 31st...when we realized it had lapsed, right after the accident, I do have faith in my insurance company...I just hope this doesn't take forever...thanks

Hope it all works out for you! Sounds like your insurance history should work in your favour.

Here in Ontario, that "no insurance" ticket is around $5000 I think! And as far as I'm concerned.... that's how it should be. If I have to pay for insurance, then so should everyone else!!

If you just weren't insured you'd be screwed, but I think you've got a good case for it just being an oversight and hopefully all will be well.

hope everything works out but may I recommend looking into auto-payment/auto renew.

With Progressive everything is done automatically so I never forget a payment.

If I had to guess, I'd say you're going to be fine.

Sorry about the date screw up, I saw my mistake right after I posted, but i think you got the jist of my message anyways.

State Farm is actually a pretty good company, and with your 10 year history (assuming it's a good history) I highly doubt they would stand on technicalities and not cover you. They would much rather keep you as a (happy) customer and raise your premiums due to the accident. Of course, they might not even raise them...again, it all goes back to your history and relationship standing with them.

The only hiccup I could imagine in the scenario you've given is if there are injuries and State Farm would be looking at a very high payout. In that case, they might not cover it. Million dollar claim settlement vs. losing a 10-year customer....they probably wouldn't think twice about losing your business in that event. Aside from something along those lines, you're most likely going to be covered.

i had a similar thing happen to me. my insurance lapsed, normally i'd just send in my check and it be fine, this time the car got broken into when it happened. so they didnt cover me even though they had my check in their hands the day before the breakin. the came back claiming that i had to sign a form because it had lapsed even though i had done the same thing 3-4 times before without signing anything. thats why to this day 10 years later i still dont deal with progressive. good lucky with yours

thanks, yeah there were no injuries and we BOTH have State Farm, which is even better I guess......I am still waiting which sucks...adjusters take forever...

No proof of insurance is not the same as no insurance. In Ontario you will be given 24 hours to provide proof, they may then either drop the "No proof" ticket, or still demand payment. If you cannot provide proof you will be hit with the big one. According to an ins. agent I spoke with, about 30% of the cars on our streets are uninsured if you can belive it. That's insane!

If you were dealing with typical ins. co. in Ontario you would have your claim denied, get a No ins. ticket, and get blacklisted and forced into "facility" ins. at about 5 times the cost of normal ins. for 6 years. It's nasty here when it come to insurance, that's for sure.

well, the insurance is not going to cover the damages..we reciecved a letter in the mail on Sat...saying the were not going to pay the damages.........PRICKS.....we are going to find a new insurance company after our policy runs out.......so now I have to find a body shop...any ideas..I live in St. Charles, IL 60174...about 45 miles west of Chicago.......NO MAACO

I understand that....why would they pay for something, that technically don't have to pay for?....Paying three premuims for the last the last 10 years, with one minor claim and paying our premiums on time, I guess doesn't mean anything except when it comes to customer service and apprecation..we have been great customers...but that is beside the point, I don't want to hijack my own thread......... Corporations suck, unless you on the upper part of it.....any ideas on shops...my guess is that it has about 4-5K damages..

*Quarter panel w/ extension/ new
* Possibly some work on frame rack/ Big $$
*Paint

man, I seriously feel for you. State Farm does NOT care about you or anyone else for that matter. A year ago I got rearended in my acura legend (almost 7k in damage) and got a ticket for wreckless driving by the Fife,WA police(who by the way, are some of the biggest dicks around) I fought the ticket and won and so I tried to claim against his insurance to get my car fixed (because it was then his fault and i did not have collision coverage, just comprehensive) and they told me to take a hike because state farm already accepted responsibility(asses). So I called state farm they said no way because I didnt have collision coverage. Basicly they denied my claim and prevented me from getting money from anyone.(and yes I did think about suing the guy who hit me but since i was not hurt I still would not have enough to fix the car after i pait the attorney)

The only 2 upsides to the story( if you can even call them that) are-my rates did not go up. and I sold the wrecked legend(almost $7k damage) with a broken speedo($145), broken door handle($250) and a motor that was now still smoking with 50wt oil in it(hehe-the poor mans way to fix worn valve guides- it worked for a while!) for 3000 to a sleazy used car salesman who came to ME looking for a car(i didnt trade it in!)

Well, the car is finally in the shop and should be done mid next week..It really felt good to drive it once again...I will keep everyone updated.....later and thanks for all the advice

Which is what I assumed. They can give you great customer service, but as soon as you have a claim they can turn to complete @!#$.

My experience with State Farm;

I had a 2001 Chevy Astro van that was sitting in my school parking lot in the early year. It was stolen from my school parking lot in between 9 and noon..well, the insurance company didn't see a need to replace my vehicle nor give me what it was worth. My premium were always paid in full at the beginning of the term, and I hadn't had ANY ticket, nor filed a claim with them before. So, they basically got free money and I was piss broke without a vehicle. Never again will I hold insurance with State Farm, due to them practically robbing me themselves.

try esurance they are pretty cheap and offer quite a bit. Also, what about covering the damages of the other car? whats goin on with that? Is state farm covering that "uninsured driver" claim? I hope so!

Sounds like you guys are GREAT customers, I mean letting it lapse, and then waiting to get it reinstated, then getting in a accident that was your fault, OR CORSE they should pay for it, YEAH RIGHT, pay your bills on time and you'll be fine, or better yet, DON'T DRIVE AN UN INSURED car and complain about having to pay for it afterwards..

You'll be the guy yelling at the REPO man for taking your car after you forgot to pay for it for a few months, then saying "The bank never told me when they were gonna repo it"

Hogwash. State farm has a legal duty to provide notcie of lapse. That's pretty cut and dry. If they didn't, they're clearly in the wrong...legally. Also, when you buy an insurance policy, you purchase trust. Obviously, you can't trust state farm not to weasel and apply deceptive business practices. You need to (a) file a complaint with the Illinois State Insurance Commissioner, (b) switch companies as quickly as possible, and (c) plan on suing if they can't prove that they provided notice of the lapse.
