Why people should carry car insurance...like they are supposed to

My fiance got rear ended on Wednesday coming home from work in her silver 2003 LS sedan. If you do the math, 03 Cavi being hit by a 1984 Buick Electra, the equation is slightly out of balance. Anyways, aside from being sore she is okay. The car held up very well sustaining $1600 in damage for new bumper, cover, tail lights (but the center filler was spared as was the trunk), and it needs a little pull on the drivers side.

We carry only liability (old car, didn't pay a lot for it) and the kid who hit her is without insurance. (@!#$)

SO if I can't get any money from him up-front we are screwed...

I am going to have the body shop do the pulling and align the trunk but I have a silver '01 parts vehicle with a perfect tail section available to me. Is it the same silver? If I do the backwards swap will the little filler panels under the outside tail lights match the 03-05 lights? Do I have to make anything to make the filler panels work?

Thoughts?

i would either make him pay, or tel him you're gonna go to the authorities...i'm sure he'll be willing to work something out then.

Well that's just it, the Missouri Highway Patrol responed to the accident and a report was filed. So he will have a ticket for no insurance and (since it is this particular guy's second offense) will get his license suspended. We have sent him a letter with the estimates and written request for compensation but if he doesn't pay we would have to file a lawsuit.

Using the parts 01 Cavi is a cheap way for me to get her car back on the road, will the colors and parts match in spite of the style difference? The parts car is not at my house so I havent been able to match the colors.

Sue the pants off of him. Add in the time it takes you to fix the car at mechanic's rates. Also sue fore the cost of a rental car while the Cav is out of commission. Teach the peckerhead a lesson he'll never forget.

truth. at the very least, sue for damages to your car and the rental.

i cant @!#$ stand drivers who dont pay insurance. i have to pay that @!#$ and yea it @!#$ blows. but considering the alternatives, ill take a monthly chunk to keep what litle else i have.

the kid is also reponsable for any medical issues and bills.
unisured motorists is a good one to add to any policy

And surprisingly, my uninsured motorist coverage is only an extra $6 a month. I guess because it's state law and you can't register your car without it (and they can technically come and find you since they have your home registration address).

I also only carry liability + uninsured, because if I crash my car it's my fault, and if it's messed up (comprehensive), it's not worth much anyway. About 3-4 years ago I realized that in about 3-4 years time, if I would've kept paying collision + comprehensive I would've paid more than the car was worth if something were to happen and they'd pay me for it. Looks like it worked out for me.

He's my backup plan.

I can't get the 01 tail section so I bought a silver OEM takeoff cover from eBay tonight. The local body shop is doing the frame pull and a friend gave me the rear reinforcement bar.

The letter with the shop estimates went out on Saturday via USPS with signature confirmation. The last line of the letter stated: failure to contact me and comply with the payment will lead to legal steps to remedy the problem.

I'll keep you posted.

hell the difffrence for me between just the collision and full coverage was like 70 bucks a year.

Talk to your insurance company. My buddy got hit by an unisurred motorist and his insurance paid for his and then the insurance company sued the guy for what it cost to fix.

all you gotta do it prove that he @!#$ up and shouldn't have been on the road in the first place and you should win a court case only thing is they might dick you around paying for it and most likely the court won't give you a ton of ,money maybe enough to cover your losses KEEP RECIPTS OF EVERYTHING. i sued someone in Massachusetts over them totaling my 02 sedan cavalier but the judge didn't see it as being more then 50/50 so i lost but it seems like they have obvious blame as long as you have a mandatory insurance law. basically if you can catch them for doing something ilegal and that happens to be involed in the accident you should be able to win it

how old was this"kid"? cause if he is under the age of 18 you can sue his parents, it may be older in some states, I don't know the entire legality of it. Sux, yes, but they still have obligations as parents to make sure he grows up. You may want to talk to your local authorities about this.

might want to look into uninsured/underinsured coverage. usually only a couple extra bucks a month. and as you know well worth it. i have no solutions on what to do, but be prepared for next time.

That's what I was thinking. Look into your policy and see if you have uninsured motorists coverage. I always have on any car that I put liability on. It's possible that the insurance man might have put it on there for you.

If that's the case, insurance will pay you, then they'll sue him.

Hi guys, it's been awhile.

We have talked to our insurance company and they said we will have to take care of going after him ourselves. Our uninsured motorist coverage only pays for our medical.

I have a bumper bar with the foam in my barn and I bought a silver bumper cover off eBay (very nice but slightly overpriced). The car comes back from the body shop in Warrensburg tomorrow with the left rear straightened out.

The "kid" is 22. We called his parents (who were complete jerks) and they said the kid moved out when he was 18 and he doesn't come around much. They basically told us it's not their problem.

I am keeping receipts (still looking for cheap outer tail lights). He goes to court for license suspension on April 12 and we filed a form to the state reporting him as the cause of an accident and not carrying coverage on his vehicle. We have been advised not to go to court until after the state takes his license so that we will have more hard evidence against him.

One day at a time...

Well, that's better than nothing. Depending on what happened or does happen, medical bills can get hefty. At least you'll get to take him to court for the money for the damage to the vehicle. You probably won't ever get money but who knows. Then, the insurance can take him for medical payments made to you.

Mike, since I wasn't there there's no way for me to know but is it possible that the parents are fed-up with their jerk of a son and simply want nothing to do with him? Imagine the grief this creep has cause you magnified 1000x. With the hell you have been through it's easy to understand your anger but a 22 year old is responsible for his own actions. I hope you can get the satisfaction you deserve from the courts.

wow i did not know your insurance system in the US was so different from here in Canada, i am a insurance broker here and uninsured motorist coverage is automatically in your coverage. also if you have liability only and some one rear ends you the accident is not your fault so yor vehicle is replaced or repaired free of charge

now this has gotten me curious and i am going to have to read up on your insurance system
