After I worked for Mercedes-Benz for nearly 5 years, this $hit does not surprise me one bit. Damn German cars...ugh.
If you have this model or know of any one who does, pass along the information.

BMW will, as part of a class action lawsuit settlement, begin an inspection-and-repair process for potentially faulty subframes in fourth-generation 3 Series models, the automaker announced this week. Commonly known by its E46 development code, the fourth-generation 3 Series saw production from 1999 to 2006.
The suit originated in 2006 and claimed that defects in E46 3 Series models cause fractures in the rear-axle supports in the subframe. Symptoms include clunking from the rear and outright subframe failure. The settlement was reached this year.
BMW advises all E46 3 Series owners and leasees to check www.E46subframeclassactionsettlement.com for information on eligibility and repair procedures. If you have already repaired a broken subframe, you may be eligible for reimbursement.

A statement from BMW North America follows:

"BMW has agreed to a proposed settlement of a class action lawsuit concerning the Sub-Frame structures on 3 Series ("E46") models produced from 1999 through 2006. Under rare conditions the attachment points of the Sub-Frame may develop a fracture or crack. BMW has prepared an inspection, approved repair procedure, and reimbursement policy in keeping with the terms of the proposed class settlement. This settlement will only pertain to US residents and is not a recall of any kind. Details will be forthcoming, pending the court's final approval of the proposed class settlement. In advance of the final settlement, BMW customers with questions should visit http://www.e46subframeclassactionsettlement.com/."

yeah thats bad. I have a 87 e30 as my daily driver and I love the car. Its good on gas handle well does not leak or burn ANY oil at 190k. planning to do a e36 m3 swap soon. should waken the car up a little. not to mention its easy to work on and parts arn't as expensive as you would think.

Under rare conditions AKA track and auto-x usage. I commend BMW for willingly wanting to fix something that isn't something they necessarily caused. They are mainly doing this for their enthusiast crowd (ME, proud owner of a solo 2 E36). Which most companies wouldn't ever dream of getting into.

or refunds for all the spun rod bearings/blown motors in all LD9 equipped GM compacts and midsize models.

This is a great PR thing for BMW to do. The down side is a car that is heavily advertised as precision engineered and benchmark quality that costs $40,000 (paying for the name and aforementioned quality engineering) To have a glaring defect like this is almost inexcusable. But good of them to own up to it.
