well today i had a friend come over to help him work on his turbo cobalt. had problem going into reduced power aswell as other @!#$.

well i grab my scanner and we go for a qwick drive down laurel(street in brunswick) and we get up to about 40 and speed limit is 35 and as fast as i looked down at my scanner i look up and some cunt pulls out in front of us, my friend automatically swerves into oncoming lane down shifts and slams gas to avoid a head-on, and recovers. well back wheels kicked out somehow and we were literelly doing a 360 degree spin and barley scuff one car but we hit another car dead on, unfourtuantly for me this was on my side, the passenger side nails the scion tc on the front driver side and i swear i felt we were in air and almost flipped. i had to kick the pass door open to get out and i see that the pass wheel is gon, so is the control arm axle and shock/strut assembly. i look up the road and see the wheel and tire laying face down with the axle still attached, and the kid in the scoin holding his shoulder and air bags deployed. and i think to myself, wtf are airbags didnt go off and half the @!#$in front was missing..

well kid in scion went in ambulance and left while my friend and i got shafted, i went home and went to erga care, came out with a mild concussion and some minor internal bleeding. i didnt go because i had alot of @!#$ to do, which im not gonna lie im hurting pretty bad. mostly from seatbelt and the impact, so i went saw one of my buddy's mom who is a doc and said had minor internal bleeding aswell and some massivly torn muscles along my ribs that could take some time to heal..

my question is, ive been told that his insurance no matter what the circumstances has to pay for my injurys/doctor bills? and will have to issue me a settle-ment for my troubles? idk ive only been in to accidents, but not like this @!#$, so id apprciate some incite as to how i go about doing this, since this is a friend and i was injured while being a passenger in the vehicle at thetime ofthe accident. thanks

well man, first off contact the insurance company and see what they have to say ... don't let them know that you have been in an accident but say you are looking to purchase insurance and wanted to know what all was covered in an accident ... then decide what you should do...
second... tell your buddy he should send me his turbo setup , since you now owe me for the advise .

i would honestly go ahead and contact his insurance company or just go ahead and go to the er. then you can get checked out and what not. when it comes time just to leave i believe you just tell them the insurance company and they will persue it from there on. you should just have to answer the questions. i understand he is a friend but if he hates you over the fact you were in his car when you two had the accident then he is not a true friend. this also is why everyone pays insurance. incase of an accident not to avoid an accident. the only problem with a claim is you bills end up over there coverage. then either you can have your insurance step in or they will persue him. but from the sounds of what he drives he might want to have his insurance persue gm on the side airbags not deploying.

Def. go to the hospital and get checked out.

Also, without airbag deployment, this will help your buddy out in his insurance claim....if you werent going fast enough to deploy....he was obviously not going to much faster than the posted speed limit.

Your buddies insurance is already fugged since mr scion went away in an ambulance, adding your health concerns, even just a check up, will not affect his insurance......at least not much.

but as mentioned, if your health is not concern enough for your buddy due to fear of insurance increase....he is not a real freind.

Glad you made it out relatively un-scathed Matt. This situation sucks, but you need to go get a full check-up ASAP. Screw the insurance companies, we have them for a reason. The accident is over so your buddy is just going to have to deal with whatever happens, and hopefully the kid on the Scion is okay too.

I believe the vehicle has to be going a certain MPH or faster for the bags to deploy. Kinda like the Cruise only works at 35mph or faster.

The airbags going off or not, the pain you are feeling would more than likely still be there, I've been hit a couple times on cars without airbags, the impact and the seatbelt holding me in place hurt like hell for a week or so. Who knows, if the airbags would have blew, it is possible you could have more injuries. Just be glad you made it out and didn't get hurt any worse.



Word of advice - next time you scan or tune a car, a private road or a empty one for than matter would be the best bet. Doing that in traffic, as you stated he was accelerating and was over the limit, 5mph or not it was over the limit. You guys got lucky you walked away, esp since the guy in the Scion went away in an ambulance.

Don't take that in a bad way, just looking out for ya.

^ i think the airbags go off at over 25 or something so they should have deployed as far as i know.

sucks to hear man, the @!#$ty streets from the 15 inches of snow wednesday probably didnt help. Idk bout brunswick but here they were still covered with snow all day today.

thanks guys. im going to call him and arrange something where i can talk to his insurance rep. right now it feels like there was a nuece around my neck and it hurts my stomach and ribs to sneeze or laugh..and shoulder is also hurting aswell. i feel bad for the car cuz it was just finished with the custom turbo kit..

well we looked more into it and the dash pads that cover the bags were in fact crack, so they tried going off, but un succesful

then let his insurance company know that, and they might go after gm to cover you and your freinds bodily damages.

You do realize that the seems are designed to "break away" easily, more than likely the tabs cracked due to the car getting hit so hard and twisting during the impact. If they "tried" to go off we wouldn't be having this talk.

The plastic dash would have exploded plain and simple, you also would have heard the bags explode. Like a Gun shot.

I had an airbag go off on accident in a door of a Porsche Carerra, it made me not be able to hear for a couple of mins. They are as loud as a gun shot.


So if they went off, they would have went off. PERIOD

Is it possible that they have a fuse for the airbags like the cavs do? If so its possible that fuse may have blown or been taken out. Just a thought...

wasnt tuning, scanning, he was to do normal driving and i was watching the log.
we were on are way to the dyno so we can do tuning

5 mph over the limit...Cause noone EVER does that

It's not like he was driving and trying to run the scanner/ computer at the same time..I mean sounds like the airbags should've gone off..don't the balts have side impact?

I dunno..I don't have any experience with this stuff...but it sounds like it takes a good shot for them to go off..My g/f got rear ended sitting at a light by a girl doing 30-35 and slammed into the car in front of her...none of the airbags in any of the 3 cars went off..

It doesn't sound like they are blaming the aaccident on the airbags, they are blaming possible injuries on them. His insurance will still go up for the accident but they want to make sure that it wasnt GM's faulty part for the airbags not going off.

All airbag BS aside, Matt, your healthcare providor should be covering the costs of your medical bills. If anything is NOT covered by YOUR insurance, then HIS car insurance will pick up the tab.

bingo. they don't make these features for them to work 50% of the time. if i'm not mistakin the crash test for side impact bags are with the vehicle sitting still and another object runing into the side of it.
