I'm going to get this scammer...

So I'm trying to sell some stuff in the Classifieds... and FINALLY after years of trying to nail some jerk, along comes this email today:

Well,I have seen the advert and I think I'll like to

Well... I'm not selling an engine... so I know it's a scam. They're going to send me a money order for way more than I'm asking, and then ask me to Western Union the balance to someone else. Hey folks, not that stupid!! I'm going to play this jackass for a while tho....

So... my response was:

Got that same exact same e-mail on my Vert being posted on Craigslist. Other than mine said "(car)".

Tell him that is fine, just send cash so you can pay the shipping without waiting for the checks to clear. Then, pocket the cash.

i had the same e mail sorta when i was trying to sell a EGR simulator. But, in the end the dude said his "accountant" sent me 1550$ instead of 50$. haahha .

I don't understand how this scam works. A cashiers check or money order can't bounce unless it's fake, and if that happens the responsibility falls on the guy that sent the check, not you. They could always purposley overpay you, and sue you for the difference if your not willing to pay them but ther's no profit in that either. If they send you a check thats no good, then demand you refund the overpayment amount to a different account, they would make money if you where stupid enough to do it before trying to cash the check they sent but who would do that. Can someone explain to me how this works I must be missing something here.

^^because knowingly depositing a bad check is actually a crime

the checks are usually sent from overseas or an innocent third party, making it hard if not impossible to trace back to the original person, so the bank goes to you.

Now the following, whether or not it works I can't say since finance law is not my specialty.

There is a term known as "holder in due course" whereby the holder has taken the check for value and in good faith believes the check to be good, If, on the other hand, the holder accepts a check that has been dishonored (stamped with terms such as "insufficient funds," "account closed," and "payment stopped"), she or he has knowledge that something is wrong with the check and therefore cannot allege the check was accepted in the good faith belief that it was valid.
